After reading the latest news segment and the words at lemon the news concerns me a great deal. Furthermore i think the prosals could have a deeper impact than what meets the eye if indeed the do go ahead with such a thing.

To me it reads that they seem intent to try and close down anything c64 related. We can see already they will have a try and close down the emulator pages like vice etc, but also sites which contain roms, such as Lemon.

The concern here is that i doubt they'll settle for this. They'll probably have a go at closing down SID sites like HVSC and SIDplay. Thats even a greater concern, could they also try and close down or license sites such as RKO,C64 Audio.com and ofcourse remix64?

I suspect they will!

It feels like they trying to earn some money, like everyone else.
Just look at the peoples who are suing mcdonalds for getting fat eating theire food... and so on.... Just redicilous...

You could argue that Remix64 is not even trading on the Commodore 64 brand - after all, we are here talking about remixes, not the original tunes!

I think it's sad that the only way they can see to make money out of it is to license/control everything. An "official" emulator and portal will make no difference to the real fans like us.

The sader thing is that they are actually alienating the people who would most likely be interested in a commodore venture. By licensing and charging/closing down sites they are hitting the self-destruct button with their own fingers.

destroy the scene then you destroy whats left of commodore.

I'll tell you what's happening:
They discovered they own the rights to the most loved 8-bit machine.
And they thinked about the only business they can do today with
8-bit machines: emulation on mobile phones to run games.

Simple as that.

A couple of points worth mentioning:

1. They can only defend the rights they have. Granted, they seem confused right now regarding the IP they own. But they couldn't, for instance, shut down HVSC, seeing as Chris is the one who owns the rights to the bulk of the commercially oriented property on that site.

2. R64 wouldn't be affected, with the exception of the use of the Commodore brand. R64 may have to drop the Commodore logo from everything. As I stated on Lemon, the use of the words 'Commodore' and 'Commodore 64' would fall into fair use; therefore the most you would have to do would be to add a disclaimer stating that Commodore is a trademark of so and so. The same goes for RKO and even more so for C64Audio.com (although the name in that case may prove problematic; mind you, with Chris's IP, he has the most clout in this fracas).

3. They would not be able to shut Lemon. He only has ROMs on his site that he's legally allowed to host, and Tulip doesn't own the rights to these.

The biggest threat is actually to the emulators, and there is little that can be done there unless the BIOS in each case has been reverse engineered (in which case they are technically legal).

As I said on Lemon, the C64 community should start to formulate some sort of unified strategy to deal with this. Maybe the Web masters of the major sites should bang heads together.

Yeah, that would be nice!

Just one season's earnings for cell phone ring tones from "The Whistle Song", which I co-wrote, was Ã‚Â£12.000. That's just one song (a hit song of course, but still impressive that ring tones can amount money in this region).
